Masterful Modern is a curated collection of end-of-line designer pieces, fine cosmetics, and rare finds, sourced from a quiet network of European makers and maisons. The store is operated by Lounge Of Brands LLC, a company registered in the United Arab Emirates.
These Terms of Sale govern every purchase made on masterfulmodern.com. They are written plainly, with the same care we give to the pieces themselves.
In these Terms, “Masterful Modern”, “we”, “us”, and “our” refer to Lounge Of Brands LLC. “You” and “your” refer to the person placing the order or visiting the site.
By placing an order, you agree to be bound by these Terms of Sale, our Shipping Policy, our Refund Policy, and our Privacy Policy. If you do not accept these terms, please do not place an order.
Section 1 - Eligibility
To purchase from Masterful Modern, you must be at least 18 years of age and have the legal capacity to enter into a binding contract under the laws of your country of residence.
You confirm that the personal and payment information you provide is true, accurate, and your own.
Section 2 - General Conditions
We reserve the right to refuse service to any person, decline an order, or limit purchase quantities at our sole discretion, at any time, and without obligation to state a reason.
Your payment data is transmitted across our payment partners’ networks under encryption. We do not store full card numbers or sensitive payment data on our systems.
You agree not to reproduce, copy, resell, or commercially exploit any portion of the site, our content, or our product imagery without our written consent.
Section 3 - Accuracy of Information
We make every reasonable effort to ensure that product descriptions, pricing, availability, and other information on the site are accurate and current. We do not, however, guarantee that the content is free of error, and we reserve the right to correct any inaccuracy at any time, including after an order has been placed.
Photographs are representative. Colours and finishes may appear slightly different on screen than in life.
Section 4 - Prices and Product Availability
All prices on the site are listed in US Dollars (USD) unless otherwise stated, and are exclusive of taxes and shipping charges unless otherwise indicated. Currency might change automatically according to your location.
Our collection is built on scarcity. Many pieces exist in single quantities or in very limited sizes. We may modify, discontinue, or remove a piece from the collection at any time without notice. We are not liable for any modification, price change, suspension, or removal of any product or service.
Where customs duties, import taxes, or VAT apply to an order, these are detailed in our Shipping Policy.
Section 5 - Products
Every piece offered by Masterful Modern is 100% authentic and sourced directly from authorised European supply channels. We do not handle replicas, refurbished goods, or items of uncertain provenance.
Certain pieces may be available exclusively online, with limited quantities. All products are subject to our Refund Policy.
We do not warrant that any product will meet every personal expectation, only that it will be as described, in genuine condition, and from the sources we state.
Section 6 - Order Acceptance and Billing
An order placed on masterfulmodern.com constitutes an offer to purchase. The order is accepted only when we issue an order confirmation by email.
We reserve the right to refuse, limit, or cancel any order at our sole discretion. This includes orders that, in our reasonable judgement, appear to be placed by resellers, distributors, or persons attempting fraud.
You agree to provide current, complete, and accurate purchase and account information for every order, and to update your information promptly when it changes.
Section 7 - Payment Authorisation
By submitting payment information, you represent and warrant that:
• The card or payment method belongs to you, or you have full authorisation to use it;
• The information provided is true and complete;
• Sufficient funds or credit are available to cover the full order amount;
• You authorise us, and our payment processors, to charge the full amount including any applicable taxes and shipping fees.
If a charge is declined, disputed, or reversed, we reserve the right to suspend or cancel your order and to recover any costs incurred.
Section 8 - Chargeback Recovery
If you have a concern about a charge made by Masterful Modern, we ask that you contact us first at info@masterfulmodern.com so that we may seek to resolve the matter directly. In most cases, we are able to address the issue more quickly and more completely than a bank dispute would allow.
Where you initiate a chargeback or payment dispute that is subsequently determined to be invalid, unauthorised, or without merit — including but not limited to disputes concerning goods that have been delivered and accepted, returns falling outside the eligibility window set out in our Refund Policy, claims of non-delivery contradicted by carrier records, or disputes arising from unpaid customs duties — you agree that Masterful Modern may recover from you the disputed amount, any chargeback or representment fees imposed on us by our payment processor, our reasonable administrative costs, and any legal costs incurred in pursuing recovery.
This clause does not limit any right you may have under applicable consumer protection law, and does not apply to disputes that are validly raised on consumer protection grounds.
Section 9 - Delivery and Risk of Loss
Delivery terms, timelines, and carrier details are set out in our Shipping Policy.
You are responsible for providing a correct, complete, and accessible delivery address. We are not liable for failed deliveries, delays, or losses arising from inaccurate addresses or from your failure to be available for delivery.
Title to a piece, and the risk of loss or damage, passes to you upon delivery to the address provided at checkout.
Section 10 - Optional Tools and Third-Party Links
The site may include third-party tools, plugins, or links over which we have no control. We provide these as a convenience and accept no responsibility for them. Any use is at your own discretion and subject to the terms of the third party providing them.
Section 11 - User Comments and Submissions
If you submit comments, reviews, suggestions, ideas, or other written content to us — whether requested or not — you agree that we may use, edit, publish, translate, or distribute such content in any medium, without payment or attribution.
You are responsible for ensuring that anything you send to us is accurate, lawful, and free of third-party rights you do not hold. You will not send anything defamatory, obscene, unlawful, or harmful.
Use of visual content you submit is addressed separately in Section 12 (Image and Likeness Rights).
Section 12 - Image and Likeness Rights
When you submit photographs, videos, or other visual content to Masterful Modern, whether by email, on the site, in a review, in response to a campaign, or by publicly tagging Masterful Modern on social media, you grant Masterful Modern a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, edit, adapt, publish, and distribute that content across our marketing channels. This includes, without limitation, our website, social media platforms, newsletters, lookbooks, editorials, and printed materials.
You confirm that you own the rights to the content you submit, that any identifiable persons in the content have consented to its use, and that the content does not infringe the copyright, trademark, privacy, or any other right of a third party.
This licence does not extend to private images that you have not voluntarily submitted to us or made publicly visible in association with a Masterful Modern reference. You may withdraw your consent to any specific further use at any time by writing to info@masterfulmodern.com. We will discontinue further use of the content from the date we receive your request, though we are not obliged to remove or recall material already published or printed.
Section 13 - Personal Information
Your submission of personal information through the site is governed by our Privacy Policy.
Section 14 - Prohibited Uses
You are prohibited from using the site for any unlawful purpose; to violate any law or regulation; to infringe any intellectual property right; to harass or harm others; to introduce viruses or malicious code; to collect or track the personal information of others; to spam, scrape, or otherwise interfere with the operation of the site.
We reserve the right to terminate access for any violation of these terms.
Section 15 - Disclaimer of Warranties and Limitation of Liability
The site and all services are provided “as is” and “as available” without warranty of any kind, express or implied, except where prohibited by applicable law.
We do not guarantee that the site will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, our total liability to you for any claim arising from or relating to a purchase, the use of the site, or these Terms of Sale, regardless of the legal theory under which the claim is brought, shall not exceed the greater of (a) USD 1,000 or (b) the amount you paid for the specific product giving rise to the claim.
We shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of profit, loss of data, or loss of opportunity.
Nothing in this section limits any liability that cannot be limited by applicable consumer protection law.
Section 16 - Indemnification
You agree to indemnify and hold Masterful Modern, Lounge Of Brands LLC, and our directors, officers, employees, agents, and partners harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms of Sale, your violation of any law, or your violation of the rights of any third party.
Section 17 - Severability
If any provision of these Terms of Sale is found to be unlawful, void, or unenforceable, that provision shall be deemed severed and shall not affect the validity of the remaining provisions.
Section 18 - Termination
These Terms of Sale remain in effect until terminated by either party. You may terminate by ceasing to use the site. We may terminate or restrict your access at any time, with or without notice, if you breach these Terms or if we reasonably suspect that you have.
Obligations and liabilities arising before termination survive.
Section 19 - Entire Agreement
These Terms of Sale, together with our Shipping Policy, Refund Policy, and Privacy Policy, constitute the entire agreement between you and Masterful Modern relating to your purchase, and supersede any prior communications or agreements.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Section 20 - Governing Law and Jurisdiction
These Terms of Sale are governed by the federal laws of the United Arab Emirates, including UAE Federal Law No. 15 of 2020 on Consumer Protection, as amended.
The courts of the Emirate of Dubai shall have exclusive jurisdiction over any dispute arising from or relating to these Terms of Sale, except where applicable consumer protection law in your country of residence grants you the right to bring a claim locally.
Section 21 - Dispute Resolution
Before initiating any legal proceeding, you agree to first contact us in writing at info@masterfulmodern.com, describing the nature of your concern and the resolution you seek. We will respond within thirty (30) days.
We commit to discuss any claim in good faith and to seek an amicable resolution. Where a dispute cannot be resolved within sixty (60) days of our receipt of your notice, either party may pursue the matter through the courts of the Emirate of Dubai, in accordance with Section 20.
Section 22 - Changes to These Terms
We may update these Terms of Sale at any time. The current version is always available on this page.
When material changes are made, we will indicate the new effective date at the bottom of these Terms. Your continued use of the site following any update constitutes acceptance of the revised Terms.
